J&J, Depuy Keep Win in Whistleblower’s Hip Implant Fraud Suit

DePuy Orthopaedics Inc., DePuy Inc., and Johnson & Johnson Servs. Inc. defeated a whistleblower’s bid to reinstate a False Claims Act suit alleging they made misrepresentations about a hip implant device.

The US Court of Appeals for the First Circuit on Thursday affirmed dismissal of the suit. The opinion was filed under seal, and will be made public at a later date, the First Circuit said in a separate order.
