Iraq showed that a federal district court erroneously awarded Wye Oak Technology Inc. $121 million in an equipment refurbishing contract breach case, the D.C. Circuit ruled Tuesday.
Iraq demonstrated that it was immune from the suit under the Foreign Sovereign Immunities Act, said Judge Patricia A. Millett in an opinion for the US Court of Appeals for the District of Columbia. The country “loses its immunity to this lawsuit only if its breach of contract caused a direct effect in the United States. It did not,” Millett said, reversing the district court’s judgment and remanding it for dismissal.
