IBM Fraud Suit Ends With Whistleblower’s Voluntary Dismissal

A whistleblower has ended his nearly 10-year False Claims Act suit alleging that International Business Machines Corp. worked with Deloitte LLP to fraudulently induce the Internal Revenue Service into signing a $265 million software contract.

Judge Amit P. Mehta of the US District Court for the District of Columbia ordered the case dismissed Friday.

Whistleblower Paul Cimino and IBM filed a stipulation of dismissal on Wednesday. Federal prosecutors filed a notice of consent with the court on Thursday. Cimino on Feb. 2 told the court that he was consulting with the government about a voluntary dismissal.
