HUBZone Contract Fraud Convictions Affirmed by Appeals Court

The president of a US Army contractor lost a bid to vacate her convictions for fraud related to an improperly won $99 million construction contract performed at Fort Drum, N.Y., the Tenth Circuit said Tuesday.

Whitney McBride, president of Odyssey International Inc., argued that the convictions should be thrown out in light of the US Supreme Court decision in Ciminelli v. United States. But the convictions will stand due to McBride’s “numerous procedural errors,” Judge Stephanie K. Seymour of the US Court of Appeals for the Tenth Circuit said.
