A whistleblower can advance his suit alleging that Homecare Homebase LLC violated the False Claims Act by developing a software-as-a-service application to inflate Medicare reimbursements for home health-care and hospice services.
Mark Schieber, a licensed physical therapist, adequately alleged that Homecare Homebase’s software was intentionally designed as a tool for health-care providers to select a higher number of services than were necessary, which caused them to submit false records to the government, Judge Claire C. Cecchi of the US District Court for the District of New Jersey said in a nonprecedential opinion Tuesday.
