Hoffman La-Roche Fraud Suit Stayed Pending Supreme Court Ruling

A False Claims Act suit against Hoffmann-La Roche Inc. alleging it misrepresented the benefits of antiviral drug Tamiflu to the US Department of Health and Human Services will be stayed pending resolution of another case before the US Supreme Court.

Whistleblower Thomas Jefferson won a delay in proceedings from the US District Court for the District of Maryland after arguing that a decision in United States ex rel. Polansky v. Executive Health Resources, will have a material impact on the standard applicable to the government’s motion to dismiss his suit.
