High Court to Hear Fight Over Service Dog

A child with cerebral palsy is bringing her fight with her school district over her service dog—a goldendoodle named Wonder—to the U.S. Supreme Court (Fry v. Napoleon Cmty. Sch., U.S., 15-497, review granted 6/28/16).

When Napoleon Community Schools refused E.F. permission to bring Wonder to school, her parents sued, arguing that the refusal violated the Americans with Disabilities Act.

The U.S. Court of Appeals for the Sixth Circuit, below, affirmed the dismissal of the suit. It reasoned that the Individuals with Disabilities Education Act required E.F.'s parents to exhaust administrative remedies under that act before filing suit.
