High Court Rejects Challenge to DOJ Dismissal of Drug Fraud Suit

The U.S. Supreme Court won’t review whether an appeals court improperly dismissed, at the Justice Department’s request, a whistleblower’s False Claims Act lawsuit alleging drug kickback claims against Omnicare Inc., CVS Health Corp., and others, the court said Monday.

Whistleblower Cimznhca LLC said in its petition for review that the U.S. Court of Appeals for the Seventh Circuit improperly said it had jurisdiction over the case when it granted the government’s motion to dismiss what prosecutors viewed as a meritless lawsuit.

The government appealed a decision by a federal court in Illinois allowing the case to continue.
