High Court Passes on Challenge to Illinois Nursing Fraud Ruling

The US Supreme Court said Monday that it won’t consider whether it is improper for Molina Healthcare of Illinois Inc. to face a whistleblower’s suit alleging that it misrepresented to Medicaid its performance of a skilled nursing facility services contract.

The US Court of Appeals for the Seventh Circuit reinstated the suit in an August 2021 ruling.

Molina argued in its petition that the Seventh Circuit erred by holding that the whistleblower’s False Claims Act complaint had sufficient detail to satisfy federal pleading standards.
