HHS Protective Gear Protest to Continue Despite Contract Awards

A US Department of Health and Human Services procurement seeking level 2 isolation gowns will continue to face pre-award bid protests from two companies, even though the department issued contracts to them, the US Court of Federal Claims said.

The awards to Airboss Defense Group LLC and StringKing Lacrosse LLC didn’t render their protests moot because they didn’t receive the “very relief sought in their Complaint,” and because they have an economic interest in a “larger portion” of the department’s procurement, Judge Philip S. Hadji said in an order denying the government’s motion to dismiss, made public May 30.
