Guardian Pharmacy Denied Bid to Delay False Claims Act Trial

Guardian Pharmacy of Atlanta LLC failed to show that a whistleblower’s False Claims Act suit alleging a kickback scheme should pause to allow an appeals court to resolve part of the case, allowing trial to begin Feb. 6.

The need for a trial wouldn’t be eliminated by allowing the US Court of Appeals for the Eleventh Circuit to decide the causation standard for demonstrating a kickback under the FCA, Judge Steven D. Grimberg of the US District Court for the Northern District of Georgia said Tuesday, denying Guardian’s motion for interlocutory appeal.
