A US Army contractor hired to deliver portable restroom trailers to Guantanamo Bay, Cuba lost an appeal challenging the termination of its contract because its bid had material misrepresentations.
The contract was void from the onset because Gilbert Solutions LLC misrepresented the trailers it intended to provide the Army at the time if entered the contract, Administrative Judge Arthur M. Taylor of the Armed Services Board of Contract Appeals said in an opinion released July 7.
