Group Wins Exit From NAACP’s Colorado Voter Intimidation Suit

A Colorado-based association won dismissal from a lawsuit alleging that it engaged in door-to-door voter intimidation efforts, a federal district court said.

Colorado Montana Wyoming State Area Conference of the NAACP and other plaintiffs alleged that the group, United States Election Integrity Plan, violated the Voting Rights Act of 1965 and the Ku Klux Klan Act.

But Tenth Circuit precedent requires granting summary judgment to USEIP because unincorporated associations can’t be sued under those acts, Judge Charlotte N. Sweeney said in a Tuesday opinion.
