Groundbreaker Lacks Standing to Challenge Army Corps Termination

Groundbreaker Development Corp.'s lawsuit challenging the US Army Corps of Engineers’ termination of its water line installation contract for default must be dismissed for lack of standing, but the contractor will get a chance to amend its complaint, a federal court said.

The government showed that Groundbreaker lacks standing because it is a terminated corporation under the laws of Virginia, Judge Margaret M. Sweeney of the US Court of Federal Claims said in a Thursday opinion.

Groundbreaker presented no contrary evidence and conceded it doesn’t have corporate status in Virginia, the court said.
