Goodwill Industries of South Florida won a permanent injunction from the US Court of Federal Claims, blocking the Defense Logistics Agency from sourcing women’s hot weather combat uniform pants from a small business and from a HUBZone business, rather than from the nonprofit group.
Goodwill had asserted that its status as an AbilityOne vendor, under the Javits-Wagner-O’Day Act, meant the agency was required to acquire the pants from it. The act requires federal agencies to purchase suitable commodities from nonprofit agencies that employ a certain percentage of blind or severely disabled individuals.
