Michigan-based General Medicine PC and others must continue to defend against the government’s False Claims Act suit alleging they improperly billed Medicare for health services in nursing homes and assisted living facilities, an Illinois federal district court said.
The US government has pointed out factual disputes entitling it to a jury trial on whether General Medicine submitted false claims to the government for payment, and whether the company did so knowingly, Judge Staci M. Yandle of the US District Court for the Southern District of Illinois said in a Tuesday opinion. Yandle denied the defendants’ motion for summary judgment.
