General Dynamics’ Repairs Appeal Advances Despite Signature Flaw

General Dynamics NASSCO-Norfolk may proceed with its appeal seeking additional compensation under a Navy ship repairs contract despite a claim certification defect, the Armed Services Board of Contract Appeals said.

The claim certification, signed by a subcontractor’s president, doesn’t satisfy the Contract Disputes Act, but General Dynamics can correct the certification before the board issues a decision on the merits, Administrative Judge Craig S. Clarke said in a decision released Thursday.

The board said the claim wasn’t completely lacking in certification under the Federal Acquisition Regulation, which would have divested the board of jurisdiction.
