Frontier Airlines Inc. must pay the US Transportation and Security Administration $5.4 million in security fees related to one-way trips customers canceled between 2016 and 2018, the US Court of Appeals for the Tenth Circuit said.
TSA didn’t exceed its authority under a federal statute when it demanded the fees from Frontier, nor did the agency improperly request them because the airline provided refunds to customers, Judge Paul J. Kelly said Monday in a split decision.
