Fluor Wins Challenge to Navy’s Jacksonville Contract Extension

Fluor Federal Solutions Inc. must be compensated for the US Navy’s unlawful extension of the company’s contract to provide base operations support services at four installations in the Jacksonville, Fla., area, the Armed Services Board of Contract Appeals ruled.

The Navy’s attempt to extend performance by six months constructively changed the contract, Administrative Judge Elizabeth Witwer said in a decision released Sept. 2 granting Fluor summary judgment.

The Navy’s exercise of a contract option to extend services was ineffective because it occurred nearly 12 months after the contract expired, the board said.
