Flatland Realty Gets Chance to Increase Recovery From Army Corps

Flatland Realty LLC will get an opportunity to increase compensation from the US Army Corps of Engineers’ revocation of a lease to provide the public with outdoor recreational activities at Carlyle Lake in Illinois, an appeals court said Wednesday.

The Armed Services Board of Contract Appeals, which granted Flatland some costs in 2023, improperly concluded that the company wasn’t entitled to recover for the loss of a building where a concession operated, Judge Alvin A. Schall of the US Court of Appeals for the Federal Circuit said in a nonprecedential opinion to reverse in part, and remand.
