FBI Agent Barred From Suing for Security Clearance Reinstatement

A former FBI agent is precluded from suing for reinstatement of his security clearance and job that he lost after sending an unauthorized letter to a court related to a corruption investigation in Louisiana, the Fifth Circuit affirmed.

A federal district court properly concluded that the Civil Service Reform Act precluded jurisdiction over Michael S. Zummer’s suit claiming that the FBI’s employment action violated his First Amendment rights, Judge Jerry E. Smith of the US Court of Appeals for the Fifth Circuit said.
