Exactech Fails to End Whistleblowers’ Knee Device Fraud Suit

Three former Exactech Inc. employees adequately alleged that the company violated the False Claims Act by knowingly providing defective replacement knee devices to Medicare, Medicaid, and Department of Veterans Affairs beneficiaries, an Alabama federal court said.

The whistleblowers’ amended complaint corrected deficient “shotgun” pleadings in their original complaint that failed to give Exactech proper adequate notice of the claims against them, Judge L. Scott Coogler of the U.S. District Court for the Northern District of Alabama said Wednesday.
