Evcon’s Union Requirement Suit Ends Following Army Corps Ruling

EVCON-CWC JV LLC’s protest challenging the inclusion of a project labor agreement in a US Navy construction procurement is dismissed, as are other disputes in the consolidated action, the US Court of Federal Claims said.

The suit is closed because all but one protester in the action, including EVCON, voluntary dismissed their cases after the court issued its Dec. 18 opinion in Brasfield & Gorrie LLC v. United States, Judge Ryan T. Holte said in a Monday order. The court in that decision enjoined inclusion of a PLA in a US Army Corps of Engineers’ solicitation.
