ERMI Secures Dismissal of Whistleblower’s License Fraud Claims

A False Claims Act whistleblower failed to adequately allege that orthopedic device maker ERMI LLC falsely told federal health-care programs that it was operating in Florida with a valid license, a federal district court said.

Elizabeth Cooley, the company’s former chief compliance officer, asserted that ERMI made or used false records and statements, that were material to false clams, by misrepresenting it had a valid license when in fact it was either unlicensed or operating with a fraudulently obtained license.
