Envision Healthcare Defeats Whistleblower’s Kickback Lawsuit

Envision Healthcare Corp. and its subsidiaries won dismissal of a False Claims Act suit alleging that they engaged in a scheme to submit claims to Medicare and TRICARE for anesthesia services that were tainted by kickbacks.

Whistleblower Jack Waters, a licensed certified registered nurse anesthetist, based his claims on publicly disclosed information, Judge Troy L. Nunley of the US District Court for the Eastern District of California said in an order entered on Friday.
