A challenge to a US Department of Transportation program intended to help certain minority- and women-owned businesses is no longer active because of an October 2025 rule change, a Kentucky federal district court said.
The change, which eliminated the race-and sex-based presumptions under the Disadvantaged Business Enterprise Program, provided the relief plaintiffs sought, Judge Gregory F. Van Tatenhove of the US District Court for the Eastern District of Kentucky said in a Thursday order, dismissing the case for mootness.
