Two Dish Network Corp. affiliates fighting to retain $3.3 billion in small-business discounts in an airwaves auction won a mixed ruling from a U.S. appeals court, which sent the matter back to the Federal Communications Commission (SNR Wireless Licenseco LLC v. Federal Communications Commission, D.C. Cir. App., 15-1330, decision 8/29/17).
The affiliates, Northstar Wireless LLC and SNR Wireless Licenseco LLC, didn’t receive fair warning or a chance to address the regulator’s concerns before the commission decided they could acquire the spectrum licenses only at the full $13.3 billion bid, the unanimous three-judge panel ruled Aug. 29.
