Dish Network Loses Challenge to FCC Ruling in $3 Billion Dispute

The FCC correctly ruled that two companies with ties to Dish Network Corp. were ineligible to receive $3.3 billion in bidding credits that were available to small businesses that participated in a 2014 spectrum auction, the D.C. Circuit affirmed Tuesday.

SNR Wireless LicenseCo LLC and Northstar Wireless failed to show that the FCC violated a remand order in a prior ruling by not properly negotiating with the companies over how to secure de facto independence from Dish, Judge Patricia A. Millett of the US Court of Appeals for the District of Columbia Circuit said.
