A repair and maintenance services contractor for the Defense Commissary Agency can move forward with a nonmonetary claim concerning the ability to bill the government for subcontractor costs, the Armed Services Board of Contract Appeals said.
J&J Maintenance Inc., which does business as J&J Worldwide Services, disagreed with the agency over its invoicing for subcontracted work. The agency declined to reimburse those costs despite J&J’s claim that on some occasions the agency approved payment for materials based on submissions provided by a subcontractor. J&J appealed, seeking in part a declaration that the contract required reimbursement.
