Covid-19 Whistleblower Lost Race to Courthouse by 19 Minutes

A whistleblower’s False Claims Act suit accusing Reditus Laboratories LLC of government fraud connected to Covid-19 nasal swab tests is dismissed because another whistleblower filed a related suit 19 minutes earlier, a federal district court said Thursday.

Whistleblower Ferzad Abdi’s suit is precluded by the FCA’s first-to-file bar because the first suit was pending when Abdi filed the complaint, Chief Judge Sara Darrow of the US District Court for the Central District of Illinois said in a decision granting Reditus’ motion to dismiss.
