Cotter Corp. N.S.L. can again argue that the US government owes it $15 million in costs incurred defending against separate radioactive material exposure litigation, the Federal Circuit said Monday.
The US Court of Federal Claims in 2023 improperly concluded that it lacked jurisdiction over Cotter’s claim seeking indemnification under the Price-Anderson Act, Judge Richard G. Taranto, of the US Court of Appeals for the Federal Circuit, said in a decision to reverse and remand.
