A Connecticut surgeon failed to show that her suit against Orange Regional Medical Center and others alleging retaliation in violation of the False Claims Act should be reinstated, the Second Circuit said Tuesday.
Tahira F. Mirza alleged that the defendants violated the FCA by firing her for calling attention to alleged “upcoding” billing practices which constituted Medicare and Medicaid fraud.
