ClearCaptions Defeats Director’s False Claims Retaliation Suit

Telecommunications services provider ClearCaptions LLC stopped a former director’s suit alleging that the company fired him in retaliation for calling attention to the company’s improper billing of the Federal Communications Commission.

Scott Swift, the company’s former senior director of customer service, failed to adequately allege that was he was engaged in protected conduct, which is required for a False Claims Act retaliation claim, Judge Morrison C. England Jr. of the US District Court for the Eastern District of California said in a Thursday order. He has 20 days to amend his complaint, the court said.
