California-based Crestview Clinical Laboratory LLC can move forward with its suit alleging the US government breached a contract with the company for Covid-19 testing services, the US Court of Federal Claims said.
Crestview adequately alleged that the government’s failure to pay the company under a pandemic-era program to help test uninsured individuals constituted a breach, Judge Robin M. Meriweather said in an April 24 opinion partially denying the government’s motion to dismiss.
The court found that Crestview plausibly alleged the parties had a binding contract. There’s “no ambiguity in offer and acceptance here,” Meriweather said.
