CACI’s Encryption Contracts Challenge Fails at Federal Circuit

CACI Inc.-Fed. lost an appeal seeking to revive its protest of the US Army’s award of encryption contracts worth an aggregate $774 million to General Dynamics Inc. and Sierra Nevada Corp., the Federal Circuit said Tuesday.

The US Court of Federal Claims ruled in 2021 that CACI lacked standing to protest because it had an organizational conflict of interest that rendered its bid ineligible.

The US Court of Appeals for the Federal Circuit affirmed on the merits, but also said the claims court “erroneously conducted a de novo review” of CACI’s purported conflict.
