Boeing Wins Revival of Contract Accounting Dispute With US (1)

The Boeing Co. can again argue that it shouldn’t have to pay $1 million stemming from the company’s accounting practice changes under a $66 million US Navy contract to provide military aircraft, the Federal Circuit said Friday.

The US Court of Federal Claims improperly found that it lacked jurisdiction over Boeing’s claim, the appeals court said in an opinion to reverse and remand.

The Contract Disputes Act clearly provides that a contractor may bring an action on a contract-related claim against the government in the claims court, Judge Todd M. Hughes said for the court. “Such is the case here,” ...
