Blue Ridge Bank N.A. beat claims that it breached its fiduciary duty when processing a Paycheck Protection Program loan for a Mississippi-based trucking company, which is accused by the government of violating the False Claims Act.
The third-party complaint filed by Bailey’s Trucking LLC and Xavier Bailey on Dec. 20, 2022, was thrown out because they didn’t receive leave from the court to file it, as required by civil procedure rules, US Magistrate Judge Roy Percy of the US District Court for the Northern District of Mississippi said in a Wednesday order.
