Biotronik Stops Fraud Suit Alleging Medical Device Kickbacks

A False Claims Act whistleblower failed to adequately allege Biotronik Inc. engaged in a fraudulent kickback scheme to generate demand for medical devices by paying for cardiologists’ vacations and making other payments, a Florida federal court said.

Christina Paul’s complaint didn’t identify any device provided to patients by the cardiologists she identified, Judge Charlene Edwards Honeywell of the U.S. District Court for the Middle District of Florida said Monday.

The complaint also lacks any allegation of a claim being submitted to a federal healthcare program for payment, the court said.
