AvKARE LLC can supply potassium chloride tablets to the the US Defense Logistics Agency under a $39.5 million contract despite a protest alleging the agency oversaw a flawed reverse auction for the tablets, the GAO said in a decision released Wednesday.
Protester XLCare Pharmaceuticals Inc. failed to show that a technical “glitch” in the agency’s auction system unfairly prevented it from submitting a timely bid to win the contract, the US Government Accountability Office said.
