Atlantic Diving Supply Inc. can move forward with a body armor contract for Immigration and Customs Enforcement despite Point Blank Enterprises Inc.'s protest at the US Court of Federal Claims.
Point Blank—which argued that the contract was tainted by an organizational conflict—filed a joint stipulation of dismissal with Atlantic Diving Supply and the government Friday stating that ICE decided to waive the potential conflict. The case is now dismissed.
An agency may waive application of OCI rules under Federal Acquisition Regulation 9.503 if applying them wouldn’t be in the government’s interest.
