Army Corps Can’t Use Labor Agreement in Louisiana Pump Project

The US Army Corps of Engineers is barred from including a project labor agreement requirement in a procurement for the construction of a pump station to mitigate hurricane damage in Louisiana, worth between $250 million and $500 million.

The agency must justify an exception to the requirement under the Federal Acquisition Regulation, amend the solicitation to remove the requirement, and give contract bidders a chance to submit offers based on the new requirement, US Court of Federal Claims Judge Ryan T. Holte said in a Wednesday judgment.
