A whistleblower’s False Claims Act lawsuit alleging that Apollo Laboratories and others engaged in a kickback scheme involving blood tests is dismissed, a federal district court said.
Judge Sidney A. Fitzwater of the US District Court for the Northern District of Texas dismissed federal claims with prejudice, and state claims without prejudice, a Wednesday judgment said. Whistleblower Rayburn Alex Thompson failed to timely re-plead his claims after the court granted the defendants’ motion to dismiss in a March 5 order, the court said here.
