Amgen Kickback Whistleblower Claims Stopped by U.S. Oncology

U.S. Oncology Inc. won dismissal of a False Claims Act suit alleging that it received kickbacks that induced it to buy drugs from Amgen Inc. because the claims were based upon publicly disclosed information, a New York federal court said.

Joseph Piacentile and Kevin Kilcoyne’s claims that U.S. Oncology submitted the fraudulent claims to Medicare and Medicaid must be dismissed because they were based upon three lawsuits filed before the whistleblowers’ 2004 complaint, Judge Sterling Johnson Jr. of the U.S. District Court for the Eastern District of New York said in a decision released Wednesday.
