Allergan’s Sanctions Bid Against ‘Lap-Band’ Whistleblower Denied

Allergan Inc. failed to convince a federal district court to sanction a False Claims Act whistleblower and his attorneys for misrepresentations in a suit accusing the company of engaging in a kickback scheme.

Whistleblower Matthew Fitzer’s most recent complaint has false information about his personal knowledge, but the record doesn’t support bad faith or intentional conduct, Judge Stephanie A. Gallagher, of the US District Court for the District of Maryland, said in an opinion made public Friday. This decision was announced in a May 30 order.
