An Alaska radiology practice defeated a former director’s lawsuit in Alaska federal court asserting that his termination violated the False Claims Act’s anti-retaliation provision.
Imaging Associates LLC provided sufficient evidence to show that it fired Gregory Dunlap for poor performance, not for calling attention to alleged Medicare and Medicaid noncompliance, said Judge Timothy M. Burgess of the U.S. District Court for the District of Alaska.
Imaging Associates showed that physicians and staff disliked Dunlap’s management style, his handling of key projects, and how he engaged in clashes with personnel, the court said Sept. 20.
