Alabama Power Co. and Georgia Power Co. are entitled to $143 million for the U.S. Department of Energy’s continuing breach of agreements to dispose of spent nuclear fuel, the U.S. Court of Federal Claims said.
There is no genuine dispute as to any material fact concerning costs the companies incurred to maintain nuclear storage facilities and programs at their power plants, Judge Patricia E. Campbell-Smith said.
The department’s contract breach, which began in January 1998, “has long been established,” the court said.
