Alabama Cancer Care Must Face Radiation Treatment Fraud Claims

Alabama Cancer Care LLC and a radiation oncologist must continue to defend against claims they violated the False Claims Act by improperly billing Medicare for radiation treatment services, a federal district court said.

Whistleblower Todd Scarbrough adequately alleged that ACC and Shelby Sanford knew the medical community didn’t generally view their approach to billing as safe and effective, Judge Corey L. Maze of the US District Court for the Northern District of Alabama said in a Tuesday opinion partially denying their motion to dismiss. Another defendant, Ashvini Sengar, showed that claims against him were inadequate.
