Afghanistan Contractor Loses Challenge to Timeliness Decision

Afghan Premier Logistics failed to convince a contract appeals board to reconsider its conclusion that the contractor didn’t timely attempt to recover $17 million under an Afghanistan trucking services contract for the US Army.

Afghan Premier claimed that it should be compensated for the Army’s failure to make proper payments under the contract, improperly canceling missions, unpaid demurrage—or layover—charges, and changing the contract scope.

The board ruled in February 2022 that Afghan Premier’s claims didn’t beat the six-year statute of limitations in the Contract Disputes Act.
