Aery’s Threat Simulation Bid Fell Short of Navy Requirements

Phoenix Air Group Inc. can proceed with a $187 million contract to help US Navy personnel simulate airborne threats because protester Aery Aviation LLC couldn’t satisfy solicitation requirements, the US Court of Federal Claims said in an opinion made public Thursday.

Aery’s challenge to the contract, known as Contracted Air Electronic Warfare Jet Services, was unsuccessful because the Navy reasonably concluded Aery’s proposed aircraft were deficient for lacking the ability to carry an under-wing device, Judge Richard A. Hertling said in a decision granting the government’s motion for judgment on the administrative record.
