Aery Protests Navy’s Electronic Warfare Contract to Phoenix Air

Aery Aviation LLC is challenging the US Navy’s decision to award Phoenix Air Group a contract to help personnel simulate airborne threats, referred to as Contracted Air Services Electronic Warfare Jet Services.

Aery, which says it submitted a bid that was nearly $36 million lower than Phoenix’s bid, could have won the contract if the Navy’s past performance evaluation adhered to solicitation requirements, according to a redacted complaint the US Court of Federal Claims made public Tuesday.

The court should enjoin Phoenix from performing the contract and order the Navy to make a new award decision, Aery says.
